The terms and conditions is currently a global parameter. This is incorrect usage. This should actually just be a normal profile field with no profile view and only an edit view. It should optionally allow you to use it in modal mode so your URL can be opened as a popup instead of requiring any custom coding for this.

For backwards compatibility keep and use the global configuration settings, but allow override of them in the field it self.
